           Equipment Import Regulations of Viet Nam for K-V Investment Promotion

                    G8 Import Documents and Procedures for importing used machinery and equipment


                       G8.1 Import Documents



                       Documents should be submitted apart from the import documents by the Law on Customs.



                         Copy of the Certificate of enterprise registration bearing the importer’s seal, or, if any, the

                         import entrusted agreement.


                        Inspector verifies information on whether the used machinery has the original manufac

                         turer's certification specifying the year of manufacture and standards, and whether the

                          machine is manufactured in the G7 countries or the Republic of Korea, or other countries.


                         Contents of the documents and inspection certificate should have and confirm the age of

                         the used machinery together with the same contents as informed on the number ˝ to ˤ
                         and ˦ to ˨ of G7.1 hereof. In the guidance of G7.1, Designated Inspection Body should
                         issue the certificate through the evaluations and assessment of each criterion specified in
                         Clause 1, related to the age limit, and Clause 2, related to the required standards, Article
                         6 according to point e) Clause 1 Article 10 of Decision 18 hereof.



                       G8.2 Import Procedures



                       The customs authority shall only initiate customs clearance procedures only if received
                       import documents satisfying the inspection certification prescribed by Article 6, and the
                       Law on customs.


                       G8.3 Goods in Storage



                       If Enterprise fails to provide a conformable inspection certificate to the customs authority,
                       the used machinery puts in storage for 30 days. Within 30 working days of storage, Enterprise

                       should report the inspection certificate. Failing to provide the conformable inspection
                       certificate within 30 working days causes Enterprise penalties.


                       G8.4 Individual Machinery in Technological Line



                       Enterprise should note the provisions of Article 8 also applied to the individual machinery
                       comprised in used technological lines except that the inspection to a technological line
                       should be conducted at the site of exporting country.
