iv. Rules for management of import used machinery, equipment and
technological lines
Article 4 declares the import under Decision 18 must comply with the law that delegates Decision
18, the Law on goods import, and bans the items that have been discarded by exporting countries or
failed to satisfy safety, energy saving, and environmental protection requirements. Even the items
have been fulfilled the criteria in Article 1 to 2, if they would not directly serve as the manufacturing
facilities of plant in Vietnam, they would fail to be exported.

Article 4. Rules for management of import of used machinery, equipment and technological lines
1. Import of used machinery, equipment and technological lines must comply with regulations of the Law on
goods import.
2. It is prohibited to import any used machinery, equipment and technological lines that:
a) have been discarded as announced by exporting countries because of their obsolescence, low quality of
causing environmental pollution; or
b) fail to satisfy safety, energy saving, and environmental protection requirements prescribed by applicable
law.
3. Only the importation of used machinery, equipment and technological lines meant to directly serve the manu
facturing of enterprises in Vietnam is licensed.

G4 Rules of Import Management
There is a reason for Point a) of clause 2. The Government of Vietnam has issued the necessary
regulations. to prevent the import of rejected and outdated technologies in some countries.
G4.1 In Case of Enterprises that were announced as removal from an industry due to
backwardness.
Facilities of Enterprise which the government announced to withdraw them from the
industry due to backwardness and obsolescence should not be exported to Vietnam.
G4.2 Certification for Safety, Energy, and Environment (ESS)
Decision 18 requires the certificates of ESS for ensuring the machinery transfer not harm
