G3.3 Define the used machinery or not.

According to clause 3 of Article 3, machinery before putting into operation after they are
manufactured is not construed as the used one. So, the machinery not applied to this clause
does not to be inspected under Decision 18.

G3.4 Age limit and calculation

G3.4.1 Age limit

Age limit is strongly connected to the codes of HS. Every item must be basically classified
in 84 or 85 of HS. After identifying the code, Enterprise can determine the age limits
falls in the 10 years or less or in the specific fields in Appendix I.

G3.4.2 Age calculation

According to the age calculation method in Appendix I, Enterprise does not need to
consider manufacturing months. The age calculation function is made by the year of

manufacture. However, despite the annual basis calculation, it is advised to consider the
time it arrives at a port of Vietnam due to the possibility of exceeding the age limits when
calculated at the port.
