           Equipment Import Regulations of Viet Nam for K-V Investment Promotion

                  Key directions were pointed out: MOST should coordinate with the Ministry of Trade and
                  Industry and other line ministries to build criteria for imported machinery, equipment age in
                  specific areas, not applying general restriction of “not-exeeding-10-year-old regulation” to all
                  machinery and equipment.



                  Decree 69/2018/ND-CP, dated 15th May 2018 provided detailed regulation from the Law on
                  Foreign Trade, which in full play from 15th May 2018 and replaced Decree 187/2013/ND-CP.

                  Its Item 5, Article 8 stated: “the importation of used machinery, equipment, technological lines
                  shall be implemented according to Prime Minister decision”.


                  MOST drafted, submitted to Prime Minister to signed the Decision No.18/2019/QD-TTg, dated
                  19th April 2019 on the importation of used machinery, equipment, technological lines which

                  has detailed regulations on criteria, documents, working process to three types of imported
                  equipment: single machinery and equipment; single machinery and technological lines whose
                  age is exceeding the regulated limit. Machinery and equipment age has been regulated in flexi-

                  ble manner. In addition to general regulation of “not-exceeding-10-year-old”, in some specific
                  areas, machinery and equipment age has been increased from 15 to 20 years (in Annex I). For
                  technological lines, importation criteria shall be evaluated on technology requirements on the
                  basis of not being listed in the prohibited, restricted ones and also being popular in OECD
                  members and not being outdated technologies. Current situation of used technological lines

                  shall be controlled through criteria of capacity (measured by numbers of products produced
                  over a time unit) or remaining capability over the designed one (not less than 85%), remaining
                  energy consumption over the designed ones (not less than 15%) and there is no regulation on

                  age limit to technological lines which comprise a number of aged machineries.


                  At present, the importation of used machinery, equipment, technological lines have been imple-
                  mented in accordance with Decision No.18/2019/QD-TTg.
