II. Context and history of used machinery and equipment import regulations of Vietnam

1. From 1997 – 2003: The Ministry of Science and Technology (MOST) launched the following
legal documents to manage used equipment importation:

Decision No. 2019/1997/QD-BKHCNMT, dated 1st December 1997 of Minister of Science,

Technology and Environment (now known as MOST) on technical regulations for used equipment
importation.

Decision No. 419/1998/QD-BKHCNMT, dated 29th April 1998 of Minister of Science, Tech

nology and Environment (now known as MOST) on amendments and complements of some
technical regulations for used equipment importation.

Circular No. 02/2001/TT-BKHCNMT dated 15th February 2001 of Minister of Science, Tech

nology and Environment (now known as MOST) on used equipment importation from foreign
investment enterprises (Chapter IV). Vietnam.

2. In 2001, Prime Minister signed Decision No.46/2001/QD-TTg, dated 4th April, 2001 on the
management of equipment importation and exportation in the period of 2001-2005. Thus, Minister
of Science and Technology singed Decision No. 06/2003/QD-BKHCN, dated 3rd April 2003 to

cancel the enforcement of the three above-mentioned documents and regulate that “used equipment
importation shall be abided by Decision No.46/2001/QD-TTg, dated 4th April, 2001 on the
management of equipment importation and exportation in the period of 2001-2005 and shall be

in accordance with all Vietnam’s regulations on labor safety and hygiene, environmental protection
and quality of products and services.

3. From 2003 to 2006, used equipment importation was regulated under the Decision
No.46/2001/QD-TTg, dated 4th April, 2001 on the management of equipment importation and

exportation in the period of 2001-2005.

4. From 2006 to 2013, equipment exportation and importation, including machinery and equipment

(both brand-new and used) were regulated by the Governmental Decree 12/2006/ND-CP, dated
23rd January 2006 of the Government of Vietnam on detailed regulation of the Law on international
trading and the Law on products and commodities quality.

5. Dated 20th November 2013, the Government promulgated Decree No. 187/2013/ND-CP, which

was in full play from 20th February 2014, replacing Decree 12/2006/ND-CP, dated 23rd January
2006 on detailed regulation of the Law on international trading. Clause 10, Article 9 of Decree
