INTRODUCTION

This annex is information for readers need to know to understand Decision 18 more deeply. The contents
are comprised of the basic and supplementary knowledge that stakeholders have wondered about the

Vietnamese import regulations of used machinery, equipment, and technological lines. The stakeholders
who the research organization of this guidebook, as a designated inspection body, has contacted since
2017 are government officials, research institutions, forwarders, enterprises, etc.

BACKGROUND INFORMATION

I. Law and Legislative Documents Systems of Vietnam

Vietnam has its own legislative documentation systems under its own law systems. The used machinery

import regulation was also announced through the documentation systems. First, looking into the law
systems, and then legislative documentation systems.
The Vietnamese legislation system consists of the Constitution as the paramount law, laws for realizing
the constitutional values, and governmental legislation including Decree, Decision of the Prime Minister,

Circulations of the Ministries and so forth effectively enforcing the laws. According to the duties and
powers defined by the Constitution, the laws and regulations are promulgated by the National Assembly,
president, and the government in the form of legislation documents as below.
