Equipment Import Regulations of Viet Nam for K-V Investment Promotion

G0.2 Law on Foreign Trade Management
The Law defines “foreign trade activities” and “technical measures", and prescribes the
provisions of the Vietnamese foreign trade management including the responsibility for
the Prime Minister and the Ministry of Science and Technology, and the prohibition of

export and import.

G0.3 Government’s Decree No. 69/2018/ND-CP

The Decree provides guidelines for the Law on Commerce and the Law on Foreign Trade
Management.

Concerning the substantive provisions of Decision 18, the Decree prescribes:

Responsibility of Prime Minister: The import of used machinery, equipment, and techno-

logical lines shall be regulated by the Prime Minister.

Scope: International exchange of goods in the forms of the export and import; temporary

importation; temporary exportation; merchanting trade; transit and other activities related
to the international exchange of goods in accordance with regulations of Vietnam law and
international treaties to which the Socialist Republic of Vietnam is a signatory.

Goods Prohibited or Requiring License to Import

* (Prohibited) Goods being used information technology products, etc.

* (Requiring License) Printing machines for printing, publishing, and textile industry.

B. General Provision

i. Scope

1. The Scope of HS code and the banned list

Enterprise should review if the export items would belong to applicable HS code, Chapter 84 or

Chapter 85, and is not on the banned lists of the Decree of the Foreign Trade Management Law of
Vietnam.
