Article 1. Scope
1. This Decision provides for criteria, documentation, procedures for import and inspection of used machinery,
equipment and technological lines in HS Chapter 84 and Chapter 85 on the List of exports and imports of
Vietnam meant to be imported and used for manufacture in Vietnam and that are not on the lists of goods
banned from import compiled by the government, the Prime Minister, Ministries, and ministerial agencies in
accordance with regulations laid down in the Government's Decree No. 69/2018/ND-CP dated May 15, 2018.

G1 Scope
Enterprise who considers exporting their machinery to Vietnam must identify first if the
equipment should be classified into HS 84 or 85.
G1.1 Identifying the heading of HS codes
To identify the corresponding headings of HS to the machinery, it is advised to refer to the
existing export-import record.
* Websites of Customs office or trade associations would be a useful tool to find an appropriate code.
* Consultation with an expert such as a certified customs broker would also be a good way to find the
applicable code. Or a machinery industry association can give useful tips to match the machinery with the
headings of HS codes.
G1.2 Parts and components not assembled in a machine
Parts and components such as molds, gaskets, plastic conveyor belts, etc. that are not
assembled in machinery may not be considered as a code of 84 or 85. This case may be
caused by customs rules like underlined texts in the box below.
The frequently asked question is whether parts in stock, such as metal molds or metal
bearings, can be classified as HS84 and transferred with the main machine according to
Decision 18. Unfortunately, it could not be classified into HS 84 but the headings for other
metal kinds. It is advised that if the parts or components are not in the list of restricted or
prohibited items under the Vietnamese regulations, take the appropriate import process
apart from Decision 18.
