SECTION I. OVERVIEW

The provisions to individual machinery and technological lines are the age limits and calculation
function, remaining production ability and its criteria, the energy consumption level, the presences
of technologies in OECD, the inspection place, and the validity of an inspection certificate.

In Article 2 of Decision 18, organizations and enterprises that import used machinery is referred to
as “enterprises”. As the article, this guidebook refers the enterprises or importers as Enterprise.

Common rules ㆍClassified in HS Chapter 84 and Chapter 85 for export to the manufacturer in Vietnam

ㆍSatisfy the standards or the regulations of QCVN or TCVN of Viet Nam or G7
countries or Korea with regard to safety, energy saving, and environmental protection

ㆍNot on the lists of goods banned by the Decree No. 69/2018/ND-CP
dated 15/5/2018 by Government on guidelines for the Law on Foreign Trade
Management

ㆍNot on the lists of potentially unsafe goods (List of Group 2 goods) in the Law on
Quality of Products and Goods

Age limit - 10 years or specific fields of HS codes

Remaining capacity At least 85% of its design capacity In case that exceeds the age limit
